Terms of Service

1. Acceptance

By accessing or using the free tools at tools.estelledigitaldesigns.com (the “Tools”), including submitting a URL for analysis, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Tools.

2. Informational Use Only — No Professional Advice

The Tools, including the HIPAA Website Compliance Checker, Healthcare Website Grader, Local SEO Analyzer, Patient Review Scanner, Social Media Audit, AI Readiness Grader, Schema Markup Generator, and Patient ROI Calculator, provide automated analysis for informational purposes only. Results are not legal, medical, compliance, tax, or financial advice and must not be relied upon to satisfy HIPAA, HITECH, state privacy laws, or any other regulatory obligation. Consult a qualified attorney, compliance officer, or licensed professional before making decisions based on any result.

3. URL Submissions — Your Representations

By submitting a URL to any Tool, you represent and warrant that:

  • you own the website, are the authorized agent of the owner, or have written permission from the owner to request this analysis;
  • your submission does not violate any third-party rights, contract, terms of service, or applicable law (including the Computer Fraud and Abuse Act);
  • you will not submit URLs for the purpose of scraping, stress-testing, competitive intelligence against sites you do not own, or any unlawful purpose; and
  • you agree to indemnify and hold harmless Estelle Digital LLC from any claim arising from your submission of URLs you were not authorized to scan.

4. No Data Retention of Scans

Scan results are generated on-demand and are not stored on our servers unless you explicitly opt in to email yourself a report or create an account. Ephemeral logs (timestamp, domain, anonymized score) may be retained for abuse prevention, rate limiting, and aggregate analytics.

5. Acceptable Use

You will not:

  • attempt to overwhelm, probe, or reverse-engineer the Tools or their infrastructure;
  • submit personal health information (PHI), payment card data, or other sensitive personal data into any input field;
  • use the Tools to harass, defame, or harm any party; or
  • bypass or disable any rate limit, authentication, or security control.

6. Intellectual Property

The Tools, their interfaces, analysis methodologies, scoring logic, and generated output format are the property of Estelle Digital LLC. You receive a limited, revocable, non-exclusive license to use the Tools and the textual recommendations we return to you for your own business. You may not resell, sublicense, or republish the Tools or bulk-extract results.

7. Disclaimer of Warranties

THE TOOLS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT RESULTS ARE COMPLETE, ACCURATE, OR CURRENT, OR THAT ANY WEBSITE FLAGGED OR NOT FLAGGED BY OUR TOOLS IS IN FACT COMPLIANT OR NON-COMPLIANT WITH ANY LAW OR STANDARD.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESTELLE DIGITAL LLC, ITS OFFICERS, MEMBERS, AGENTS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, REGULATORY FINES, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE TOOLS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE TOOLS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

9. Indemnification

You will defend, indemnify, and hold harmless Estelle Digital LLC from any claim, demand, loss, damage, or expense (including reasonable attorneys’ fees) arising from (a) your submissions to the Tools, (b) your breach of these Terms, or (c) your violation of any third-party right or law.

10. Governing Law, Arbitration, Class Action Waiver

These Terms are governed by the laws of the State of Washington, without regard to conflicts-of-law rules. Any dispute arising from or related to the Tools will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Clark County, Washington. You and Estelle Digital LLC each waive the right to participate in a class action or class-wide arbitration. Either party may bring a claim in small-claims court for qualifying disputes.

11. Changes to These Terms

We may update these Terms from time to time. The “Effective” date above will reflect the most recent update. Your continued use of the Tools after changes constitutes acceptance of the revised Terms.
